2023.03.22 17:08 AprexBT Taking a small corporation to small claims court for unpaid invoice

Thanks for taking the time to read this.
I did about 8 weeks of work for a cabinet company last September to October. I partially invoiced early October for approx. $11000 and after 3 weeks of non payment I stopped all services. They have since made two payments totaling approximately 15% of total value. The last payment made was in early January. They have been communicative for the most part... Will get back to me with in a week of emailing. I have been informed of the hardships that the company has gone through.
The company was owned by one person and then was invested into by a General Contracting firm to grow the business and theirs (General contractor is owned by two people). The original owner maintained operational oversight and the GC only checked in weekly on financials. In December, the original owner was forced out due to his mismanagement of the company. Countless debts between suppliers and subcontractors (including me). The GC has now taken full management of the cabinet company but I'm not aware of the shareholder status of the previous owner.
This leaves me now waiting to be paid when they can. My work was across multiple jobsites so placing liens was not an options for the amount owed. I have been extremely patient as I understand what they are up against to keep this company afloat... But that doesn't mean that their GC company hasn't been flourishing. I know that the partners that bought in could clear my debts if they took from their GC company and not the cabinet company. But I assume as they are both incorporate entities that they are insulated from one another.
This leaves me with two options.
I take them to small claims court. I would imagine it wouldn't be hard to get a judgement as they have already made payments to the invoice which confirms the amount owing. Plenty of emails to trace back and forth, at no time has there been a dispute of the invoice amount. But where does this get me? If the cabinet company has no money, what good is the judgement? Can the judge order the garnishment of the GC company to pay my bill? Can I take the company and the directors to court? Or is the judgement just a another piece of paper and I can't get blood from a stone.
Option 2... I'm at this point now but don't want to pull the trigger as it may have unforeseen repercussions. They use social media a lot to promote their GC business and they have a well known name around town. If I write a post warning other contractors not to do work for the cabinet company and reference that it is owned and operated by the GC it will hopefully force their hand into paying me. There are some possible downsides... It could hurt my future business possibilities, could it be considered slander? Does it hurt me getting a judgement down the road? My intention is to write up the post and send it to them first to give them the option to pay before it goes live... Or is that blackmail?

39M, 16M NW fully liquid, but have made some of the worst investment decisions ever so that my IRR over the past 10 years is negative.
Have gained lot of perspective from discussions here.
Need some advice but first some context.
Got laid off job at 29. Was earning around 200k +options back then. Had just invested 400k all cash deal in a house back in home country as investment.
So at 30, I was without a job and 90% of my savings locked illiquid. The real estate firm went bankrupt. Not a single brick laid till date. Depression set in. Round one.
Tried looking for a job for 6 months but started reading on the side and got fascinated with a topic in public policy (negative effects of big tech). Over the next 2 years, worked on a book. Launched it at the age of 32. Wife's job kept us going but just about in VHCOL city.
Book became a bestseller and has crossed 1M copies now. Been on the speaking circuit 2015-19. Speaking fees started at early five figures and went close to 6 figures per speech just before covid.
Earning by year 2013: 0 2014: insignificant (5 figures) 2015: 1M 2016: 2.5M 2017: 3M 2018: 3.2M 2019: 3.9M
Covid happened and speaking circuit evaporated overnight. Went into identity crisis for 5 months. Round two.
Hadn't had time to invest till now because of breakneck growth. I know cash is trash but I was traveling 200 days a year on the speaking circuit.
Around mid of 2020, speaking still dried up but started seeing people make millions in the market.
Panicked about not having invested all these years. Jumped into the market. Bought 100k worth of index funds but they were growing at 10% while switching were growing 10x.
Fomo + greed set in. I had to make up for years of idle cash.
Long story short, I had put in 5M into stocks by Nov 2021. This had grown to 9M (huge positions in Asana, Snow, Zm, Tsla, Rblx etc). I kept on pumping but just held waiting for party to continue. I felt I had found my second act. Everything was turning to gold. That has today fallen to 1.8M. Everything from COIN to OPEN. No diversification. Didn't exit anything because, well, buy and hold.
Went into depression for a few months. Round three.
Got my act together early 2022. Decided to reinvent from traveling keynote speaker to remote consultant and boards. Helps spend more time with the kid. Built a huge network from speaking days and personal brand + continuing book sales help.
Income since covid 2020: 500K (Big drop compared to previous years) 2021: 1M 2022: 4M (with new board + consultant model)
Finally started going more into index funds 2022 onwards but still in the red with that as well.
I'm trying to get my act together now. Need some advice here (and perhaps just some psychological help)
  1. I have always loved what I do and still do. So plan to still continue. But I can't get over the money I lost in the market which I may never recover. Also cant forgive myself for not investing all those years. But I was too scared to lose everything again the way I did.with my real estate investment. Wanted peace of mind through principal protection.
Essentially I have been the worst investor over the past decade. How do I forgive myself for that? I sit up nights sometime thinking about where I could have reached had I just done indexfunds.
  1. How do I invest now? Yes cash was trash, but its giving me 4-5% now while my stocks are a lost cause. How do I start diversifying with around 10+M cash still available and adding 200-300k every month to it.
  2. I'm not interested in RE. But the fear of losing it all again like I did at 30 keeps coming back especially after losing money on shit stocks in 2021. How do I fix that?
  3. I still can't spend freely without counting even for sub 100 dollar amounts because I keep blaming myself for the money lost.
Essentially, how have you guys got over bad money decisions? And what should I do going forward to get it right?

Alpine boss Otmar Szafnauer believes Alpine could have challenged Ferrari during the Saudi Arabian Grand Prix.
Both Esteban Ocon and Pierre Gasly were running in P8 and P9 respectively behind Charles Leclerc, and were matching the Ferrari driver's lap times in the 1:34s during the closing stages of the race.
But, with 10 laps to go, both drivers backed off, with Szafnauer claiming he was wanting to overtake the Ferraris but was overruled by the engineers.
"We were in no man's land for a while and then we turned the car down. We were conservative on the tyres, just to make sure they lasted till the end," he said to Sky Sports F1.
"I was hoping we could push up a little bit more to the Ferraris, but was overruled by the engineers."
Alpine showed encouraging pace during Friday practice, with Ocon displaying good race pace during FP2.
However this seemed to disappear on Saturday as they struggled to qualify higher than P7 and P10 on the grid.
"We've got to look at it. We don't run light [fuel] on Friday, so it's not the amount of fuel we have in," said Szafnauer.
"We just we have to analyse it and see where we can do a little bit better on Sunday versus Friday."

My [22F] boyfriend[23M] of nearly a year recently got diagnosed with ADHD, and it's been a real eye opener for both of us. He tends to exhibit classic textbook symptoms and as someone who is neurotypical, it sometimes irks me as I fail to understand his behaviour. He tends to cut me off when I'm talking, forgets a lot of things, and sometimes I fail to be understanding and think he's being lazy or doesn't care about me enough since I am anxious by nature, although, I do know he is a sweetheart overall, and I absolutely adore him, but I was hoping someone could give me tips on ways to better understand ADHD behaviour and be more accomodating and not let expectations get in the way because he's my favourite person and I don't want to hurt him by being insensitive.

After the shitshow that was the release of the game back in 2020, I decided I wouldn't play it before it would be "fixed". After patiently waiting for 2 years, and after many deserved updates, I've got to say: what a game. It's a shame it will continue to live on with that desastrous original release in everyone's mind, because I truly believe this game is worth playing.
I started about a month ago, and put around 90 hours into it. I went through all secondary missions, interest points and whatnot. I only just finished and feel that emptiness that washes over you after a good story has ended.
Sure, there are still a few negatives: physics and AI are still clunky sometimes, especially when looking at... cars? The way the don't wreck or barely, the way they clip through obstacles when summoned (so you're left with a vehicle that has no doors, bashed windows, and no bumpers like wtf?) ; I'm a bit disappointed there are no more "real" development with important characters after their arc is finished, especially romanced ones (looking at Mass Effect as a good example on how to expend the player's relationship with others) ; and a myriad of bugs here and there, the game remaining true to its reputation!
However, I was pleased to discover that none of these aspects outweighed the positives of the game. I love the pace of it. I was disturbed at first by the erratic rythm of NC, of combat, of the music... but after 2 or 3 hours, I realised it was just the essence of the game itself, and it became more and more compelling. This is Night City. This is what life in the "city of dreams" is like.
I also found that the pace at which you receive news from secondary characters was well executed: I never had a dull moment thanks to that. One minute I think "well, I've done everything in this area, let's scoop the next one, kinda boring doing the same thing again", and the next I receive a call from a contact prompting a new quest. And because you meet these people during different phases of the story, their arc develop one after the other too. I was never bored during 90h of gameplay, because something to do always fell onto my lap right on time! I also appreciated that when characters told you you would have news soon, it could actually be days or weeks before they actually get back to you... Just like in real life.
Another real positive aspect of this game is... the people. Everyone you meet has a compelling backstory, some characters have very interesting development arcs, and every last one of them, even during the gigs, are different. I never felt like I was doing the same mission over and over again with gigs, because even if the "type" of gig could be the same as another, the context would change, the reasons would change, and I think it's one of the only games I played that made me feel like repeating the same missions didn't feel like it.
It could be a point all to itself: the game has a very impressive range of missions. I ended up reading every single texts relating to NCPD hustles quests to understand what had happened; even then, some of the quests would guide you even further to deepen what is otherwise just a little bit of lore. Every side mission is built up completely differently from the previous one, and, as I wrote earlier, every gig is unique in its own way.
Also, the city... oh, man, the city! It's so huge but so easily crossable, there are so many details everywhere, every neighborhood has its own identity, it feels really alive too! I liked stopping in the street randomly when I overheard conversations between NPCs. I liked discovering new back alleys everytime I came back somewhere I had already been. Or staring at the view, with the changing weather impacting the lighting of the scene and neons dying vent smoke... It is, in its own messed up way, a really beautifully crafted city. Props to CDRed for that.
Last but not least: the story is very well told. It kept me on board the whole time (even if I made Goro and Hanako wait for me for a few... weeks), the voice acting is good, the immersion is well managed, and... did I already tell you the characters are great?
I'll conclude by saying: I waited 2 years to play Cyberpunk 2077, and it was totally worth 90 hours of my time. The current state of the game (at least on PC) makes for a really good game, with let's not forget a few bugs here and there, butnothing game breaking. I can't wait for the release of the DLC to get back into it.

Hello everyone. Here is a summary of what is going on with my dog. He is a 6-year-old husky that we adopted at the beginning of January. All we really know about his past is that he lived outside. He is now living in the house (we have 3 other huskies). He is extremely afraid of me (I am a woman), but not my husband. If I walk up to him to take him outside, he will pee. If I enter a room he is in, he will run away. If I try to throw treats to him, he won't eat them. He won't let me feed him. At this point, my husband is the one letting him out, feeding him, etc. because I felt like I was just traumatizing him more by trying to take him outside. I now basically ignore him. If I am the only one home, he hides in another room. If my husband is home, he will come out and lay on his lap on the couch. At first, he was fine with being crated while we were gone from the house (in fact, he was basically couch to crate, crate to couch for the first month - he didn't want to be anywhere else), but now he hates being in the crate (my husband is the one who puts him into the crate - not me). If we leave him out, though, he will chew things he shouldn't (he is quite fixated on drink coasters). He cries and scratches and chews at the crate. He is walked before he is crated (which is max 4-6 hours). He gets along well with the other dogs - he will snuggle with them. He walks nicely with me, too, if my husband hooks him up to the leash and brings him outside. Our vet just prescribed Trazadone, so we will start that tonight, but she also referred us to veterinary behaviorists. We live quite rurally, so getting in to see one is going to be difficult as they are all quite far away and I am not sure it would be good to trap doggo in the car with me for so long. I should note that he's not reactive (no biting or growling or barking towards me). In the meantime, I was wondering if anyone has an advice?

So I managed to get 30B running today and I wanted to put it through its paces. I then realized that I should probably apply the scientific method here and directly compare the outputs of the three models I have with the same questions.
I wanted to test the outer limits of their capabilities, since we already know they can handle the fairly simple AI stuff, so I collected a bunch of Turing style questions from various sources and blogs and threw some of my favorites at Alpaca 7B, 13B, and 30B, then recorded their answers for your comparison. All models were run with a temp of .35 and given 8 threads.
How come time flies like an arrow but fruit flies like a banana?
Model 7B: Because it takes longer for seconds to pass than minutes, and therefore more of them have passed since you started counting.

Hello,
My son has now outgrown his Maxi-Cosi Mica carseat and I don’t know what to do next..
Mica car seat: Birth - approx 4 years Max weight: 18kg Height: 40 - 105cm
My Son: 2 years 8 months Weight: 18.4kg Height: 98cm
Going by his weight and height alone he meets the requirements for a high back booster seat using the vehicles 3-point seat belt. Most 5 point harnessed seats max out at these limits. I don’t feel he is mature enough at under 3 years old to use a HBB seat.
Anyone else had this problem? Any recommendations?

I know both bakeries are decades-old, but I only recently heard that Bert's Bakery was founded after a brother of the original Boonzaaijer's owner decided he didn't like how things were being operated and split off. I'm aware that Bert's Bakery is no longer owned by the original founder or that family, but I'm still interested if there's any truth to the rumor I heard. If it is true, what are the details behind it?
I'm not looking for opinions on which area bakery is best since I've already decided that for myself.

Recently I heard the term 'forever partner' used and it took me a moment to register they were using it in lieu of husband, or spouse. I also saw the usage of 'adopting plants' and 'plant parent' in another situation where they could've just said 'take a plant home' and 'plant owner'.
It feels like the language that shelters have used to anthropomorphize dogs (e.g. fur parent, forever home, dog mom) to churn them out is slowly but surely permeating our culture. How much longer until we are an 'iPhone foster home'? Or you're not a parent, you're a 'forever mom'? Are people gonna get praise on Facebook for 'adopting a good boi toasto', rather than buying a 1986 used toaster from a charity store?
Little by little this keeps spreading and I detest it.

2023.03.22 17:00 jared_d Are there any available reviews of the Standard Range AWD Model Y?

I have an order in for a LR AWD Model Y, but the date keeps getting pushed out. Current Delivery date is now Late April/May. Very afraid that the current Federal ($7500) and NJ State ($2000) will no longer be available by then.
I'm trying to gauge whether or not it would be worth grabbing a non LR version, since they seem to be much more readily available. I am concerned about the range - losing ~35 miles is significant, but maybe not a deal breaker, but i'm not sure if that's the only difference with the car.
Trying to wrap my head around it, would appreciate any information at all.

Hello! I would like some opinion on my shop and products. I started a few weeks ago and already have 7 listings. I know it's not too much yet, but I was expecting having some sales by now...
I create branding and business templates for creative small brands and entrepeneurs, with a modern bohemian style. I decided to create this type of product because I've always liked branding design and it's something I feel I'm good at and seems profitable.
I've been promoting my shop on pinterest to help with the traffic and I have been improving my shop visuals and politics, etc to make it more professional. I have some daily views but no sales.
I try to niche down my produtcs to a specific public with a more specific key words and I've trying to improve SEO.
Any coments on what can I improve more? Your honest feedback would truly help me.

I am considering two vehicles available in my area and would appreciate advice on the situation.
A dealership down the road has a 2023 Subaru Impreza Hatchback Base for $22,900 + tax & registration, and no dealership fees.
A different dealership has a 2020 Subaru Impreza Hatchback Base with 60K miles, a clean carfax and one private use owner for $19,000 + Tax & registration, and no dealership fees. On the below carfax, I don't see any services after the sale, but that could be normal I suppose. Right now, I am leaning toward the new car as I feel that resale value would be higher in 5 years (5 year old car with 75k miles vs the used car (8 year old car with 135K miles, but $4k cheaper). Also, the 36K mile warranty and reliability of a new car is very appealing.
